These terms are the agreement between you and EUCDOJO, LLC ("EUC Dojo", "we", "us") for using eucdojo.com and the EUC Dojo rider app. By creating an account or using the site or app, you agree to these terms, our Privacy Policy and our Community Rules. If you do not agree, please do not use them.
Electric unicycles can hurt you. Riding an electric unicycle, or any personal electric vehicle, can lead to serious injury, permanent disability or death, for you and for people around you. Falls can happen at any speed, including from a wheel cutting out, a mechanical or battery problem, road conditions, weather, traffic, other people, or a mistake by you.
You ride at your own risk. You decide where, when and how you ride, and you are responsible for your own safety, your own wheel, and following traffic laws and local rules. We strongly recommend a helmet and protective gear every time you ride.
The app is information, not supervision. Everything in the app and on the site, including ride listings, meeting spots, routes, titles, belt tests, skill descriptions, tips and posts from other riders, is general information only. It is not riding instruction, and it is not supervision. Nothing in the app means a place, route, ride or skill is safe for you.
Rides other riders post are not EUC Dojo events. Rider posted rides are organized by the rider who posts them. EUC Dojo does not organize, check, supervise or insure them, and does not check the riders, the route or the wheels. You join them at your own risk.
Belt tests. Belt test videos are filmed by you, on your own, where and when you choose. Only try a skill you can do safely. Film in an open, safe space away from traffic and people, and stop if you do not feel in control. EUC Dojo does not supervise belt tests you film yourself. A belt, title or rank is a fun measure of progress in the EUC Dojo community. It is not a license, certification or guarantee that you can ride safely.
Waivers. Rentals, lessons and EUC Dojo events need a signed EUC Dojo waiver. For those activities, the waiver you sign applies in addition to these terms.
It stays yours. You own the posts, photos, comments, messages, ride listings, profile details and belt test videos you share ("your content").
You let us use it to run EUC Dojo. You give EUC Dojo a free, non exclusive, worldwide license to store, show, copy and share your content inside the app and on eucdojo.com, and to show public items (such as posts, profile details, titles and Legends results) to other riders, for as long as it is on EUC Dojo. Belt test videos are only watched by EUC Dojo staff. We will not share a belt test video, or use your content in ads, without asking you first.
Only post what you have the right to post, and follow our Community Rules. EUC Dojo has zero tolerance for harassment, hate, threats, sexual content, spam and other offensive content. We can remove any content, and suspend or remove any account, that breaks these terms or the rules, or that we believe puts riders at risk. You can report content and block riders in the app.
Other riders' content is theirs. We do not check everything before it appears and are not responsible for what other riders post, say or do, on the app or off it.
Titles, packs, belts, Chi, Legends boards and similar features are for fun and have no cash value. They cannot be sold or traded. We can change how they work, correct mistakes, and add, change, reset or remove them at any time. Cheating, such as fake accounts, fake rides or someone else's belt test video, can lead to titles and belts being removed and the account being closed.
The Used EUC Marketplace helps riders find each other. EUC Dojo reviews listings for accuracy and obvious red flags, but does not own, inspect, test, ship or guarantee any wheel or item, and is not a party to any sale. Buyers and sellers deal directly with each other and are responsible for their own deal, including payment, the condition of the item and following the law. Meet in a public place, check the item before you pay, and never send money in advance.
Payments. Card payments are handled by Square. Prices are shown before you pay. You agree to pay for what you order, plus any shipping and tax shown.
Shop orders. Most EUC Dojo gear is made to order and shipped by our print partner. If an item arrives damaged, faulty or not what you ordered, email us within 30 days of delivery with a photo and we will replace it or refund it. Because items are made to order, we cannot take returns for a change of mind or the wrong size.
Rentals and lessons. Bookings follow the details shown when you book and the rental agreement and waiver you sign, including the deposit hold on your card and your responsibility for the wheel while it is with you.
VLTG and Voltage are not part of the rider app. Anything to do with VLTG on eucdojo.com is covered by its own terms and risk disclosure, which you must read and accept before taking part. Nothing in the app or on the site is financial, investment, tax or legal advice.
The EUC Dojo name, logo, designs, app, site and everything we made for them belong to EUCDOJO, LLC. You may use the app and site for your own, personal use. Please do not copy them, sell them, scrape them with bots, try to get into accounts or systems that are not yours, get around our limits or security, or use the app to break the law.
If you believe something on EUC Dojo uses your work without permission, email our copyright agent at [email protected] with the subject "Copyright notice", or write to EUCDOJO, LLC, Attn: Copyright Agent, 1445 Marble Crest Way, Winter Garden, FL 34787. Please include: your name and contact details; the work you own; where the item is on EUC Dojo (a link or a description we can find); a statement that you believe in good faith the use is not authorized by you, your agent or the law; a statement that your notice is accurate and, under penalty of perjury, that you are the owner or are allowed to act for the owner; and your physical or electronic signature.
We will remove or disable the item and let the person who posted it know. If they believe it was removed by mistake, they can send us a counter notice with the details the law asks for. We close the accounts of riders who repeatedly post other people's work.
The app and site are provided "as is" and "as available". To the fullest extent the law allows, EUC Dojo makes no promises of any kind, stated or implied, including that they will always work, be free of errors, be secure, or that anything shown in them is accurate. Things can go down or be lost, so keep your own copies of anything important to you.
To the fullest extent the law allows, EUCDOJO, LLC and its owners, staff and partners are not responsible for any indirect, incidental, special or punitive losses, or lost profits, data or goodwill, from your use of the app or site, from any ride, event or meetup arranged through them, or from the actions of other riders. To the fullest extent the law allows, the most EUC Dojo owes you for any claim about the app or site is the greater of $100 or what you paid EUC Dojo in the 12 months before the claim. Some places do not allow some of these limits, so they apply only as far as the law allows. Nothing here limits responsibility that the law does not allow to be limited.
You agree to cover us for claims, losses and costs (including reasonable lawyer fees) that come from your content, your riding, your deals with other riders, or your breaking these terms or the law.
You can stop using EUC Dojo and delete your account at any time in the app, under Settings. We can suspend or close your account, or stop offering any part of the app or site, at any time, including if you break these terms or the rules. The parts of these terms that by their nature should last, such as riding at your own risk, the limit on what we owe and how disputes are handled, keep applying after your account is closed.
If you have a problem, email [email protected] first and give us 30 days to try to fix it. These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute that is not settled will be handled only in the state or federal courts for Orange County, Florida, and you and EUC Dojo agree to those courts.
Changes. We may update these terms. We will change the date at the top, and for important changes we will tell you in the app or by email. Using EUC Dojo after a change means you accept the new terms. For some changes the app will ask you to agree again.
The whole agreement. These terms, the Privacy Policy, the Community Rules and any waiver or agreement you sign with us are the whole agreement between you and EUC Dojo about the app and site. If any part is found not to be enforceable, the rest still applies. If we do not enforce a part straight away, we have not given up the right to. You may not transfer these terms; we may transfer them as part of a sale or reorganization of the business.
